Acknowledgment

Thank you for visiting HEX BOIS. These terms of service outline our obligations to one another and ensure that everyone that uses our services feels safe and can enjoy the game!

When we say “we”, “our” or “us”, we are referring to HEX BOIS.

When we say “services”, we are referring to the services that HEX BOIS publicly offers, these include: the HEX BOIS website (hexbois.com).

When we say “you” we are referring to yourself, the individual who accesses our services.

We also have a privacy policy that is incorporated into these terms of service. You should also read and understand our privacy policy as it is important.

Age restriction and responsibility of parents or guardians

By accessing our services, you confirm that you are at least 13 years of age and meet the minimum age requirement of digital consent in your country or residence.

If you are old enough to access our services but not old enough to have the authority to agree to these terms of service then you must request that your parent or guardian accepts them on your behalf. If you are a parent or guardian that agrees to these terms of service on behalf of your teenager, you must read and understand these terms and are beholden to them, you are responsible for the actions of your teenager on our services.

What you can expect from us

We're actively developing new content and features for HEX BOIS, this means that our services will change often which includes introducing new services and removing old ones. If you are interested in what is changing on HEX BOIS, please read our changelog.

We are always aiming to minimise downtime and interruptions to the services that we offer, however, we aren't always perfect. This means that there will be times when you are unable to access the services offered by us. Your content may become unavailable or completely removed during such outages, please read the “Content” section of this document for more information. We are not liable for any such outages, disruption in service or loss of data.

Content

User submitted content

Our services allow you to post and share your own content. You are responsible for this content and it is your responsibility that it is accurate and appropriate.

By sharing and posting content on our services, you licence us to modify and publicly display that content on our services. You retain any and all of your rights for any content you share on our services. It is also your responsibility to protect these rights.

We are not responsible for content shared by users on our services. Any content shared through an account is the responsibility of the account owner, regardless of who was operating the account at the time it was shared.

Content restrictions

To make sure that HEX BOIS is a safe environment for all users we enforce the following restrictions on content shared/posted by users on our services. Content on our services must not be:

  • Unlawful or promoting unlawful activity
  • Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups
  • Any form of spam generated by either a person or machine. This includes unsolicited advertising
  • Containing or installing any computer viruses or other content that is designed to disrupt normal usage of software or hardware
  • Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights
  • Impersonating any person or entity including HEX BOIS and its employees or representatives
  • Violating the privacy of any third person
  • False information
  • Any content that is deemed harmful (by us) to users of HEX BOIS

Content backups

Whilst we endeavour to maintain our services and backup necessary data, outages and disruptions in our services may result in data loss which includes loss of content submitted by users. We are not responsible for any data loss or damages caused by loss of data.

Fairplay policy

We aim to make HEX BOIS as fun as possible for everyone. This means that we hold a strict fairplay policy. If you are found to be breaching this policy then you are considered to be breaching the terms of service and this will therefore result in a termination of your HEX BOIS account as well as restricted access to our services.

A breach of the HEX BOIS fairplay policy would include:

  • Hacking, gaining unauthorised access, DDoS or other computer/cyber attacks (relevant authorities would be notified for this criminal behaviour as per the Computer Misuse Act and other relevant legislation)
  • Using automated “scripts” or machines to simulate a player's actions
  • Exploiting bugs or known vulnerabilities in our services (please report bugs to [email protected])

All content that is created by us is protected by copyright. This content can not be duplicated or distributed by any other party. This includes but is not limited to: images, text and computer code.

Links to other websites

We may link to other websites from our services. These “external” websites may not be affiliated with HEX BOIS. In this case, we have no control over these websites and are not liable nor do we take responsibility for any of their content or services. You use and visit these sites based on your own discretion. Note: you never need to visit another website to use HEX BOIS.

Embeds of HEX BOIS

HEX BOIS is often embedded into other websites, this often helps us to be discovered by new players. We are not responsible for any content shown on these websites or their conduct. Note: you never need to play HEX BOIS on another website, you can always play it natively at hexbois.com.

Termination

Your right to terminate

You are free to terminate your account and use of our services at any time. If you do not have an account, then no action is required on your part. If you have an account, please contact us at [email protected] to make us aware that you wish to terminate your account. We will promptly delete your account, read more about it in our privacy policy.

Our right to terminate

We reserve the right to suspend or terminate your account and/or access to our services without notice. In such events we will aim to make contact with you to make you aware of these changes however we are not required to do so. These are the reasons which would constitute such actions:

  • A breach of any one or more of the clauses defined within this terms of service
  • You are causing harm to our services or other users of our services
  • We reasonably believe that a suspension/termination is necessary to protect you or others
  • Your account has been inactive for 1 year

In the event of a suspension/termination, we reserve the right to suspend/terminate any and all accounts we believe to be operated by you as well as any future accounts that may be created or operated by yourself as well as restrict access to our services when you are using them without an account.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
